Justice Ekwo has no power to remove me from office, says Umahi

The embattled Ebonyi State Governor, Mr. Dave Umahi, has faulted the judgement of the Federal High Court, which removed him and his deputy from office on Tuesday March 8, 2022.
He said that the judgement was null and void as Justice Enyang Ekwo of Federal High Court, stressing that the judge has no power to remove him and his deputy from office.
The governor also argued that there were there are three ways of removing a sitting a governor – he could be removed through resignation, death or impeachment through the House of Assembly.
Umahi however pointed out that no constitutional provision empowers the judge to do so.
He therefore urged his supporters to disregard the judgement, stressing that he was not going to obey it.
His words: “Gentlemen of the press. I know you are very anxious to talk with me but I want you not to be anxious at all; no tension at all.
“In the first place, there is no constitutional provision for any hatchet man to remove a governor. There are three ways in which a governor can vacate his sit: It is either by death, resignation or impeachment by the House of Assembly. There is no any other constitutional provision that empowers a hatchetman to turn the constitution upside down.
“I listened to the judgement of Ikwor and it is very obvious that he was on a mission. He was making every efforts to upturn the rulling of the Supreme Court and Appeal Court on issues like this.
“We have had the rumours before now that he was determined to give judgement against all known laws and the constitution to embarrass APC and to embarrass the federal government.
“For me, I do not feel worried. I feel so sorry for the Judicially, the executive may have problems; the legislature may have problems; but once justice could be purchased, then we are in trouble in this country.
“The ruling this afternoon is a clear evidence that this country is in trouble. And let me tell you that the same judge has over 10 cases against Ebonyi State Government and you can imagine what he is going to rule.
“We have petitioned him to NJC and I will follow it up at all costs to ensure that this man is brought to Justice.
“I want you to disregard the judge, it is null and void. There is a subsisting judgement in Zamfara and Ebonyi State. We have chosen the one to obey and we will not obey his ruling. We will obey the ruling of a competent court of equal and level that says you can not sue a governor. The sections of the constitution is very clear.
“No civil nor criminal proceedings could be brought against a sitting governor. This is not a pre-election matter; this not a tribunal matter and so he has murdered justice in this country.”
